OVERVIEW
This website and course platform is operated by Dr Michelle Appleton, trading as Calm Willing Confident Horses (“we”, “us”, “our”).
Calm Willing Confident Horses provides online education, programs, community forums, and support services related to horse training, handling, and human skill development (“Services”).
By accessing this website or enrolling in any course or program, you agree to be bound by these Terms of Service (“Terms”), including all policies referenced here. If you do not agree, you must not access or use the Services.
SECTION 1 – ELIGIBILITY AND USE
You confirm that you are at least the age of majority in your place of residence and that you are legally capable of entering into this agreement.
You agree not to use the Services for any unlawful purpose or in violation of any applicable local, national, or international laws.
SECTION 2 – NATURE OF SERVICES
All Services provided by Calm Willing Confident Horses are educational in nature.
They do not constitute veterinary advice, medical advice, diagnosis, treatment, or professional certification. Decisions relating to horse health, soundness, veterinary care, or rehabilitation remain the responsibility of the participant.
You acknowledge that working with horses carries inherent risk and that you are responsible for your own safety and the welfare of your horse.
SECTION 3 – COURSE ACCESS AND DELIVERY
Course access is provided for the period specified at enrolment, currently 18 months unless otherwise stated.
Access includes educational materials and, where applicable, participation in community forums and support activities.
We reserve the right to update, modify, or reorganise course content to maintain educational quality.
SECTION 4 – COMMUNITY AND USER CONDUCT
If you participate in community forums, you agree to engage respectfully and professionally.
We reserve the right to remove content or suspend access if behaviour is abusive, defamatory, misleading, unsafe, or disruptive to the learning environment.
Feedback, videos, and submissions shared within the platform may be used for educational purposes within the Calm Willing Confident Horses community forums connected to each course.
SECTION 5 – FEEDBACK AND INTELLECTUAL PROPERTY
All course materials are the intellectual property of Dr Michelle Appleton and Calm Willing Confident Horses.
You may not copy, distribute, reproduce, or repurpose course content without written permission.
By submitting feedback, videos, or comments, you grant us a non-exclusive right to use that material for educational or promotional purposes unless otherwise agreed.
SECTION 6 – PRICING AND PAYMENTS
Prices are subject to change without notice. We reserve the right to refuse or cancel enrolment at our discretion.
You agree to provide accurate billing and account information and to keep your details up to date.
SECTION 7 – REFUNDS AND EXTENSIONS
Refunds are governed by the specific Refund and Participation Policy displayed at enrolment.
In summary:
- Refunds are not provided for change of mind
- Conditional partial refunds may be considered only if all stated participation requirements are met
- Where a horse is identified as unsound or injured, an extension of access may be offered in place of a refund
- Nothing in this policy limits your rights under Australian Consumer Law where applicable.
SECTION 8 – THIRD-PARTY SERVICES
We may provide access to third-party tools or links. These are provided “as is” and are used at your own risk.
We are not responsible for third-party content, services, or platforms.
SECTION 9 – DISCLAIMER OF WARRANTIES
The Services are provided “as is” and “as available”.
We do not guarantee specific outcomes, behavioural changes, or results for you or your horse. Progress depends on multiple factors including horse health, environment, skill application, and consistency.
SECTION 10 – LIMITATION OF LIABILITY
To the maximum extent permitted by law, Calm Willing Confident Horses and Dr Michelle Appleton are not liable for any indirect, incidental, or consequential loss arising from use of the Services.
Where liability cannot be excluded under Australian Consumer Law, liability is limited to the resupply of the Services.
SECTION 11 – INDEMNIFICATION
You agree to indemnify and hold harmless Dr Michelle Appleton and Calm Willing Confident Horses from any claims arising from your misuse of the Services or breach of these Terms.
SECTION 12 – TERMINATION
We may suspend or terminate access if these Terms are breached. Obligations incurred prior to termination survive.
SECTION 13 – GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.
Participants accessing the Services from outside Australia do so at their own initiative and are responsible for compliance with local laws.
SECTION 14 – CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
